Agreement to Terms
By accessing and using FarmersGrown services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.
These Terms of Service, along with our Policies and Privacy Policy, constitute the entire agreement between you and FarmersGrown.
Service Description
What FarmersGrown provides
FarmersGrown is a farm-to-table delivery service connecting customers with local farmers and artisans across Southern California. We provide:

Grove Essentials, Abundance, and Discovery plans
Custom Box Creation
Select individual items from our marketplace
AI Meal Planner
Personalized meal planning with local ingredients
Recipe Collections
Featured recipes with one-click ingredient ordering
Gift Collections
Curated gift boxes and gift subscriptions
Professional Delivery
Via Uber Direct from our distribution hub
Service Area
Currently serving Orange County, launching in 4 cities near Anaheim, CA. Expanding to Los Angeles County, San Diego County, and the Inland Empire.
User Responsibilities
Your obligations when using FarmersGrown
Eligibility to Use Service
•You must be at least 18 years old or the age of majority in your jurisdiction to use FarmersGrown
•Children under the age of 13 are strictly prohibited from creating accounts or submitting personal information
•By using our services, you represent and warrant that you meet this requirement
Account Information & Security
•Provide accurate and complete information when creating an account
•Maintain the security of your account credentials and never share your password
•Notify us immediately of any unauthorized use of your account
•Update your information as needed to ensure accurate delivery
Order Placement Responsibilities
•Review your order carefully before submitting
•Ensure someone is available to receive delivery at specified address
•Provide accurate delivery instructions and contact information
•Notify us of any dietary restrictions or allergies before ordering
•Place orders at least 48 hours in advance
Payment Terms
How payments are processed
Payment Processing
Payment is processed at the time of order placement or subscription sign-up. We accept major credit cards, debit cards, and other payment methods as displayed during checkout.
Security: All payment information is processed securely through industry-standard payment processors. We do not store your complete credit card information on our servers.
Pricing Structure
15% Service Markup
All product prices include a 15% service markup (8% platform operations + 7% market compliance fee). This markup supports our platform operations and keeps the service free for farmers and artisans.

Delivery Fees
Delivery fees are calculated based on distance from our distribution hub to your delivery address. Fees are clearly displayed before order confirmation.
Price Changes
Product prices are set by vendors and may change without notice based on seasonal availability. All prices displayed in USD include applicable taxes.
Subscription Terms
How subscriptions work
Auto-Renewal
Your subscription will automatically renew weekly on your scheduled delivery day. You will be charged the subscription fee plus any applicable taxes and delivery fees.
Important: To avoid being charged for the next delivery, you must cancel or skip at least 48 hours before your scheduled delivery date.
Cancellation & Modifications
You can cancel your subscription anytime with no fees or penalties
Skip individual deliveries before the 48-hour cutoff
Change subscription plans at any time
Modify your box contents or add extra items
Refunds on Subscriptions
Refunds are not provided for subscription periods already completed. If you cancel before the next billing cycle, you will not be charged. Partial refunds may be issued for service disruptions or major delivery failures at our discretion.

The AI Meal Planner provides suggestions for informational and inspirational purposes only. It does not constitute medical, nutritional, or dietary advice. Always consult healthcare professionals for specific health concerns or dietary requirements.
•AI-generated meal plans are based on available inventory and may change
•We strive for accuracy but cannot guarantee all suggested ingredients are in stock
•Nutritional information is estimated and should not replace professional dietary advice
•You can customize any meal plan before adding ingredients to your cart
Recipe & Content Usage
All recipes, photos, and content published on FarmersGrown are protected by copyright. By using our platform, you agree to the following:
Permitted Use
Personal, non-commercial cooking and meal preparation
Saving recipes to your personal account
Prohibited Use
Republishing, redistributing, or selling recipes
Using content for commercial purposes without permission
Removing watermarks or attributions from photos

No Warranties Disclaimer
FarmersGrown provides services "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

- •Uninterrupted or error-free service operation
- •Accuracy of product information, pricing, or availability
Limitation of Liability
To the fullest extent permitted by law, FarmersGrown's total liability for any claims related to our services is limited to the amount you paid for the specific order in question.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of (or inability to access or use) our services.
Third-Party Products
Products sold through FarmersGrown are provided by independent farmers and artisans. While we carefully select our vendors, we are a platform connecting you with local producers and are not responsible for product quality beyond our stated refund policy. Product variations in size, appearance, and quality are inherent to farm-fresh goods.
Allergen Warning
Products may contain or be processed in facilities that handle common allergens. We cannot guarantee the absence of cross-contamination.If you have food allergies, consult with us before ordering, but understand that we cannot provide absolute allergen-free guarantees.

We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as outlined.

Data Security
We implement appropriate technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet is 100% secure.
Force Majeure
FarmersGrown is not liable for any delays or failures in performance caused by circumstances beyond our reasonable control, including: severe weather, natural disasters, crop failures, transportation disruptions, labor shortages, supply chain issues, pandemics, government restrictions, or vendor emergencies. We will make reasonable efforts to notify affected customers and provide alternatives when possible.
Account Termination
Either party may terminate this agreement at any time. FarmersGrown reserves the right to suspend or terminate user accounts for violations of these terms, including but not limited to:
- •Fraudulent activity or payment issues
- •Abusive behavior toward staff, vendors, or delivery partners
- •Repeated order cancellations or refund abuse
- •Violation of intellectual property rights
Upon termination, outstanding orders will be handled according to our policies.
User Content & Feedback
By submitting reviews, feedback, photos, or other content to FarmersGrown, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display such content in connection with our services and marketing. You represent that you have the right to submit this content and that it does not infringe on any third-party rights.
Dispute Resolution
Any disputes or claims relating to your use of FarmersGrown shall be resolved through binding arbitration on an individual basis in accordance with the American Arbitration Association's rules.
Class Action Waiver: You agree to waive your right to participate in class action lawsuits or class-wide arbitration against FarmersGrown.
Severability & Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, along with our Policies and Privacy Policy, constitute the entire agreement between you and FarmersGrown and supersede all prior agreements or understandings.
Changes to Terms
FarmersGrown reserves the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Significant changes will be communicated via email or through our platform.
Continued use of FarmersGrown after changes are posted constitutes acceptance of the updated terms.
